1. Scope

These terms and conditions apply to all services provided by MediaMass ("we", "us", "our") in the area of mass video posting and social media marketing. By using our services, you accept these terms in full.

2. Description of Services

MediaMass offers automated video distribution services for social media platforms, in particular TikTok, Instagram and other platforms. Our services include:

• Automated uploading of videos to multiple platforms
• Distribution of up to 250,000 videos per day (depending on package)
• Analytics and performance tracking
• Technical support

3. User Obligations

The user agrees to:

• Only upload content for which they hold the necessary rights
• Not use copyrighted materials without authorization
• Comply with the community guidelines and terms of service of the respective platforms (TikTok, Instagram, etc.)
• Not distribute illegal, offensive, defamatory or harmful content
• Not post content that violates laws or harms third parties
• Keep login credentials secure and not share them with third parties

4. Copyright and Content

The user guarantees that all uploaded content is either their own property or that they hold the necessary licenses and permissions. MediaMass assumes no liability for copyright infringement caused by user content. The user indemnifies MediaMass against all third-party claims arising from the violation of rights through uploaded content.

5. Platform Compliance

MediaMass operates within the APIs and guidelines of the respective social media platforms. We reserve the right to restrict or terminate services if platforms change their terms of service. The user accepts that:

• Platforms may suspend accounts without prior notice
• Algorithm changes may affect performance
• MediaMass provides no guarantee for specific reach or engagement rates
• Platform rate limits may affect posting speed

6. Disclaimer of Liability

MediaMass is not liable for:

• Account suspensions by social media platforms
• Loss of content due to technical issues or platform decisions
• Lost profits or indirect damages
• Service interruptions due to maintenance or force majeure
• Changes in third-party APIs or policies

Liability is limited to the amount the user has paid for the service in the last month.

7. Data Protection

We are committed to protecting your data in accordance with the GDPR. Details can be found in our Privacy Policy. We only store and process data that is necessary for providing our services. Social media account credentials are stored encrypted.

8. Payment and Subscription

All prices are exclusive of statutory value-added tax. Billing is monthly in advance. In the event of late payment, we reserve the right to suspend the service. Cancellations must be made in writing (by email) and are effective at the end of the current billing period.

9. Termination

Either party may terminate the agreement with 30 days' notice at the end of the month. MediaMass reserves the right to terminate the service without notice in the event of violations of these terms and conditions. In the case of termination without notice by us, a pro-rata refund will be issued.

10. Changes to the Terms & Conditions

We reserve the right to amend these terms and conditions at any time. Changes will be communicated by email and take effect 14 days after notification. In the event of significant changes, users have a special right of termination.

11. Applicable Law

The laws of the Federal Republic of Germany shall apply. The place of jurisdiction is the registered office of MediaMass, provided the user is a merchant, a legal entity under public law or a special fund under public law.
